Terms of Service

Welcome to Smak. These Terms of Service (“Terms”) govern your use of the Smak website and services (“Smak,” “we,” “us”). By creating an account or using Smak, you agree to these Terms. If you don't agree, please don't use Smak.

1. What Smak is

Smak is a platform that helps people host and join home-cooked meals. We provide the tools to list meals, request seats, communicate, and rate one another. We are not a party to the meals themselves, we do not host, cater, or supervise them, and we are not the organizer of any gathering arranged through Smak. Hosts and guests deal with one another directly and at their own discretion and risk.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use Smak. You are responsible for keeping your account credentials secure and for all activity that happens under your account.

3. Your responsibilities

You agree to:

  • Provide accurate information about yourself and your meals.
  • Treat other members with respect and behave lawfully and safely.
  • Honour the commitments you make — show up, or cancel with reasonable notice.
  • Disclose material information for a meal (allergens, pets, alcohol, accessibility).
  • Comply with all local laws, including food-safety, health, and tax rules that apply to you.

You agree not to harass, endanger, discriminate against, defraud, or misuse other members, and not to use Smak for any unlawful or harmful purpose.

4. Hosting a meal

As a host, you are solely responsible for your home, the food you serve, and the safety of your guests. You are responsible for understanding whether any licences, permits, insurance, or tax obligations apply to you. You choose which guests to accept and may cancel a meal, subject to the notice expectations described in the app.

5. Attending a meal

As a guest, you attend meals at your own risk. You are responsible for informing hosts of allergies or dietary needs and for your own conduct and belongings. You acknowledge that Smak does not verify the identity, background, home, or food safety of any host.

6. Ratings and content

After a meal, hosts and guests may rate and review each other. Reviews must be honest and must not be abusive, defamatory, or misleading. You retain ownership of content you submit, but grant Smak a licence to host and display it in connection with operating the service. We may remove content that violates these Terms.

7. Assumption of risk

Meeting new people and entering private homes carries inherent risk. You understand and accept those risks. To the fullest extent permitted by law, you agree that you participate in meals at your own risk and that Smak is not responsible for the conduct of any member or for anything that happens before, during, or after a meal.

8. Disclaimers and limitation of liability

Smak is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Smak and its team will not be liable for any indirect, incidental, or consequential damages, or for any loss or harm arising from meals, member conduct, food, or your use of the service.

9. Suspension and termination

You may stop using Smak at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other members.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know. Continuing to use Smak after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable there, without regard to conflict-of-law rules.
